Switch from Tier 1 (Entrepreneur) to Tier 2 (General) URGENT

Hi all,

I have an urgent question regarding my Tier 2 (General) application which I intend to make next week.

I'm currently on Tier 1 Entrepreneur visa which I applied for in October last year and have only just received earlier this month (early March).

I haven't registered a company (I would be required to do so within 6 months of receiving the Tier 1 Entrepreneur visa) or got to the stage of employing any local residents.

Now I'd like to switch in-country to Tier 2 (General) because a great job opportunity is presented to me. I have all documents ready now and meet all prerequisites for a Tier 2 application, with my sponsor, CoS, RLMT etc. all in place.

Now the question is, is there any problem with me doing this? By using a 3-year long Entrepreneurial visa for only less than one month, will I be suspected of misusing the immigration system and get refused of the Tier 2 visa for this reason?

I know it's a tricky situation but I've got no choice now but to go ahead with it. Any input will be much appreciated.

Thanks manci. My only concern is that I have only used the Entrepreneurial visa for a few weeks and now I want to switch. Will the visa officer think I previously applied for the Entrepreneurial visa only for the purpose of prolonging my legal stay in the UK and not genuinely wanted to set up a business and become an "entrepreneur". Can he refuse my Tier 2 application "on general grounds"? How likely is this going to happen do you reckon?

The caseworker has to follow the rules.
