Hi all again

from 06/04 , new rules prevent dependant partner (who became the dependant before 09/07/12) of Tier 4 PBS migrant who approved ILR based on long residence cannot apply for FLRM under Part 8, It means they need to meet new financial requirement.

BUT

Applicants can use an old version of an application form for 21 days following the increase, but these should be accompanied by the new fee. New versions of our application forms will be available on our website.

Apparently, it allows someone can use old FLR M form for 21 days after 06/04.

does it mean, for these 21 days dependant partner of Tier 4 PBS migrant who approved ILR based on long residence can apply under PART 8? Because if they use old form then they have to fill Maintenance question, instead of new requirement question according to the old form.

in page 17 of FLR M Form
If you were granted leave to enter or remain as a partner following an application made before the 9th July 2012 you are not required to complete section 7A (its a FM), Proceed to 7B MAINTENANCE (its a PART8)

so, is this 21 days transitional period or what?

can someone clarify this please,

P.S. It happened to me in FEB 2012. I sumbitted old TIER 4 app form even though new one was out. I didnt know new one was out though. Fortunately It was during this 21 days. Obviously I filled the form what it asked in that old form. Leave approved.

The new rules will apply from 6 April regardless of which form you use.

You need to complete FM. Why not complete the new form?

You need to complete FM. Why not complete the new form?

well, the issue is, you can't bypass the new rules by filling in the old form so regardless of which section you complete on the old form, your application will be considered according to the new rules if you apply on or after 6 April.

Yep You r absolutely right. Nobody dare to do risk filling old form , after 6/4 just for maintenance fund , Was Just curious. I wouldnt to that.
