Tier-2 General - Change of Employment - CoS n Visa Impact

Visa Type:- Tier-2 General Migrant
Type of application : Changing to a new employer (Potential CoS sponsor)

I am currently on a Tier-2 General migrant and my visa is valid till 19/12/2014. I am in the process of changing my job and identified a potential employer and i have the following queries which needs clarification.

Existing employment queries
---------------------------
1. My current employment notice period is 3 months from the date of resigning, Will my COS will be revoked from the date of resignation or by end of notice period (which is 90 days)

2. How long i can stay in the UK post my COS cancellation from my existing employer ?

3. What will happen to the Visa which is valid till 19/12/2014

New employer queries
---------------------------
1. Can my potential /new employer can request for a new CoS while i am with my current employer in Unresigned status

2. Can my potential / new employer can request for a new CoS while i am with my current employer while serving my notice period

3. Do i need to go back to my country (India) for stamping my visa against the new CoS ?

4. Is there any cooling off period needed between to Visa's

ILR and Settlement

I have spent almost 17 months in the UK and once i serve my notice period it will be 20 months, Will this period will be considered for ILR/Settlement if i change my employment with a new COS Sponsor.

if you want to serve the notice period than the work start date in the new CoS should be the day following when you finish in your present job.

Your new sponsor can assign the CoS to you at any time but CoSs must be used within 3 months.

Don't resign until you have your new CoS AND your application has been approved by UKBA.

There si no cooling-off for in-country switching applications.

Your time in both the present and the new job will count towards the 5 years needed for ILR.

Hi Manci,

I have few more queries, appreciate your input on it, if possible.

Tier-2 General - Change of employer


I am already on a Tier-2 General Visa and I am about to close an offer with an Potential employer and who is new to the Tier-2 CoS Process (They already have sponsorship license). I have the following questions

1- Does the new potential employer have to go through the new Resident Labour market test for the new COS ?

2- What is the typical processing time for a new COS for some one already in the UK?

RLMT is required unless your job is shortage occupation or the salary is 150K or above.

CoS can be assigned within 20 minutes if all info is to hand for the employer (your address, passport number, personal details, etc).

Does Tier-2 new applications (within UK) has to go through English Language tests ?, If yes, does it applies to dependent also ?
