Another Stamp 4 query

Hi all,

I have been looking around some boards and websites and ended up confusing myself more than actually answering questions!! :?

I am Irish, My GF is Brazilian, We are planning on getting married shortly. ( We will be getting married abroad, in the US). She currently has a study visa and works part-time. Her student visa was only renewed a few weeks ago.

My questions are :

1. Is it a Stamp 4 visa she would transfer over to?
2. How long does it take to get a spouse visa?
3. Is there a chance she could be refused?

We are looking to buy a house to move in together after the wedding so the time frame for visa, Temp stamp etc would be great help as the mortgage would be dependant on her status.

There are meant to be 2 stamps in this case. Stamp 4 and 4EUFAM. Now because USA is not the EU which means you arent exercising your EU treaty right, then yes it is a Stamp 4 that she will transfer over

A spousal visa could take anytime from 2 weeks to 12 months or even more. I suggest when applying for her visa you need to show more proof that your marriage is not of convenient (Sham).

Well there isn't an automatic entitlement for residence for her in this case. She could be refused if some documents that was asked wasn't produced, if they believe so much that its a sham marriage or if she has had serious immigration or other offenses here in Ireland.

In your case, I dont think you have anything to worry about.

From your post I think you both live in Ireland and your Brazilian GF holds an Irish Student visa.
If you get married in Ireland or in US all you have to do is take your marriage cert to the GNIB office in Dublin 2 or to your local Garda station your spouse will be issued with Stamp 4 immigration status. Brazilian don't need visa to enter Ireland so she doesn't have to apply for Spouse visa.

After reading up so many different places it just seemed to be a nightmare field that we would be walking thru blindfolded.

No Problem liger. If your spouse would have valid Irish visa that time she would be issued Stamp 4 on same day. I wish you best of luck!!
