Claiming Benefits On permanent Residency

Hello

Guys me and my wife both attained permanent residency in december 2012 and now we have a chid who is british national.

We are trying to claim council tax and housing benefits since july 2012 with no luck. Each time the local council ended up asking for more and more documents.

This time they've asked me to provide a document confirming my right to access public funds.

Spoke to home office and they clearly refused the request as they cant issue such a letter.

On the passport stamp it says "no restrictions on the holders activities" but apparently its not enough.

I have an indian passport and my wife possess a polish passport.

My query is that is there any document that can satisfy the council's demand??

Please any help would be good.

You should have ILR or a PR document either in Passport or BRP to show you have PR/ILR. This is enough proof. You need to apply for the benefit and get a decision in writing. You can then appeal this decision and take it to a tribunal if necessary.

Got ILR in dec 2012, then how can you try claiming HB and council tax benefit in july 2012 ?

I suggest you contact one of the Councillors for the Council Ward in which you live. Such Councillors usually have good contacts with the Council office dealing with HB and CTB claims.

All Sorted Yesterday..I threatened them of legal consequences and then they asked me come down and bring all the documents along with me.

It was silly receptionist who never took the photocopies of our permanent residency stamps and copied only the front pages of the passport.

They apologised to me and assured that the case will be sorted by the end of next week.

They mentioned it doesnt matter what status i've got as long as my wife is EEA member and got the permanent residency status it should be fine.

Now just have to wait for the outcome.
