Hi all,

I've just received a Tier 2 general visa, having switched from Tier 1 PSW. Unfortunately the expiry date on my BRP is given as April 19, 2013 instead of being valid for 3 years as I expected. After initially contacting my caseworker because I believed the date to be printed in error, he got back to me saying that actually because my employer specified the expiration date of my CoS as April 5th, 2013, hence my visa expires on April 19th (2 weeks later).

I'm extremely confused by this, because when my company first received their sponsorship licence we received an email from UKBA explaining that the unrestircted CoS expires on a yearly basis on April 5th, and a new one needs allocated each year. Therefore it seemed logical to enter April 5th as the expiration date when we requested the CoS.

Yesterday I mailed another letter to my caseworker explaining all this and including a printout of the email from UKBA which misled us. Honestly if I have to submit a brand new application 1 month after receiving my visa just because my employer put in one wrong date, I can't even conceive of that. And so I await their response. But anyway I was just wondering if anyone on here has gone through the same thing and can share their experience of what the outcome was.

UKBA did not mislead you and your sponsor, both of you misunderstood the rules.

It is the CoS allocations that are only for one year, the period of grant in your case can be up to 3 years. The sponsor could have put the work end date 3 years from the work start date in the CoS.

Re-apply with a new CoS before your leave expires on 19 April if you can. Hopefully your sponsor already has, or will shortly have, a CoS allocation for 2013/14 so that one can be assigned to you.

Perhaps mislead wasn't the right word then, the point was that this email was the source of confusion which caused my sponsor to make the error. I understand that it's our fault for not understanding the rules properly - what I'm wondering is if there's any chance of correcting this error at this point without having to submit a brand new visa application.

Based on your response I assume you are of the opinion that they won't be very understanding in this matter.
