Dependency Question

Post by samira_uk » Wed Apr 03, 2013 11:23 am

Hi All,

I have a question for EEA permit for spouse of EEA national. Is it required according to the rules that non-EEA spouse should be dependent on EEA national? It is a bit unclear in the guidance. It is said that no documents needed for this purpose but it is not clear that if this requirement should be met or not?

The non-EEA spouse is now outside the UK and works and is going to get a letter from his employer. He answered the questions to employment section in application form. Now he is worried that he should be dependent to his wife who is in the UK and working there? In addition, there is question in application form about EEA national employment and the amount she spends to support family and again he is worried that if she should put 0 or put something to show she support her non-EEA national husband?

Thanks in advance

There are no requirements in the EEA Regulations for the spouse of the EEA national to be dependant on the EEA national.

Non such requirement exist.

You are required to show that you are a Qualified person , if you have been in the UK for more than 3 months, and that you have contracted a valid and genuine marriage.
