English requirement...

Post by Sunilrana80 » Thu Apr 04, 2013 1:44 pm

Hi friends,
This one is for a family friend...on dependant visa
She entered uk on 31/12/2011 on tier 2 spouse visa...
Husband got ilr on 4/06/2013
Applying for visa extension....as the paper work was not complete for ilr....even though she cleared her life in uk test..

Q. Her appointment for extension is on 11/04/2013 at croydon. (Using flr m)
Does she require to clear her ielts exam?

Any help would be great as the visa expires soon...

In this situation, isn't the paperwork for FLR(M) the same as SET(M), apart from the English language and KOL respectively?

She did not have 6 proofs of residence for here for the past two years.(which apparently she did not know and cleared her life in uk test)
....so does she need her ielts for her application using flr(m) ?

Doesn't FLR(M) have the same requirement in her situation?

Flr(m) does not ask for 6 proof of residency in uk for two years...she hardly has two or three..even the utility bills are not on her name...they are in name of her husband....no bank account....they apparently approached a lawyer for ilr who asked them 6 proofs with her name on them..,which they could not get...

Unfortunately, you're mistaken. Section 12c of the FLR(M) application form - Documents:
If you are applying as an unmarried or same-sex partner, or if you answered no to question 5.1 and are
applying for an extension of stay although you have completed or nearly completed 2 years’ leave to enter

or remain in the UK as a partner, in addition to the relevant documents in sub-section 12A, you must provide
the following documents:
6 items of correspondence addressed to you and your partner at the same address as evidence that you have
been living together during the past 2 ye
ars. See Note 9.

Actually, if she hasn't completed her 2 years in the UK, then she may/should continue to apply as a Tier 2 dependant. Moreover, there is no English language requirement in 319C.
