My wife is under a tourist visa, she is from Guatemala. I am a British citizen and would like to apply for settlement, or study visa for her. And we have two children living in Guatemala. Can my wife have any chance of being accepted?

I'm presuming she's here in the uk? Is she still within the validity of her visa? How far along is she? Do you want to bring the kids over too? How old are they? Are they british citizens?

Yes, she still here with her valid visa of six months, at the moment she have 3 months with me. My daughter is 14 and my son 5 years old, they are not british. Yes I want to bring them here.

Then assuming she's only just found out she's pregnant - you should read the requirements of the spouse visa (http://ukba.homeoffice.gov.uk/visas-imm ... spouse-cp/) and she should return home and apply from there.

She cannot normally apply from within the UK and if you attempt it you will be in for a much longer waiting period and possibly a longer period until she can settle permanently.

You should be aware that if she remains in the UK to have the birth under a tourist visa - she will probably be subjet to charges from the NHS.
