Switch tier1 to tier2 visa whilst tier 1 extension pending

Hi I have a question which I'm hoping someone can help me with.

My Tier 1 General visa expired in February 2013. Before expiry i applied for an extension and my application is currently being decided.

However, i'm unlikely to be successful in my extension applciation as i don't meet the points requirement.

My employer is prepared to now sponsor me under tier 2 (General). However, whilst i'm still legally entitled to work pending my extension application would I be able to now apply to switch from tier 1 (General) to Tier 2 (general) in country given that my tier 1 (general) visa expired back in February?

Or will I have to leave the Uk and apply for a Tier 2 Visa in the country where i was born and therefore lose the period I have clocked up for ILR requirements?

ANy help will be greatly appreciated!
