Initial Leave expires on 8th april

Post by salonbalm » Sat Apr 06, 2013 9:45 am

Dear Friends,

My friend's initial leave is to expire on 8th April, he has already applied for extension by post.

His mother wants to visit him. She applied under family visitor in India, but was informed VFS office that she can not apply as a family visitor because the sponsor's (my friend) visa will expire before her travel date. She then applied under general visitor category, but was again refused by VFS as my friend's BRP card was attached with the application.

1) Could someone please advise if she can apply for General tourist visa and not show my friend's visa card, but simply put it as Limited leave to remain in the "any relatives in UK box"?

2) Also since she is planning to stay in the UK for 4 months, can she still show my friend's residence as her accommodation?

I know that this might not be the right forum for this, but still would appreciate the help.

Thanks in advance

It does not matter that the son's leave is expiring if the parents can show their independence from him in order to qualify as general visitors. They need to apply showing they have the necessary means to fund their visit without any type of sponsorship. That would include the means to provide for their own accommodation (means and intention to pay for a hotel or rented). The problem with relying on the sponsorship of a third party is that there is no indication that the third party will be, or has permission to be, in the UK to support them.

No reason why she cant apply again, Friends house wouldnt be the best accomodation place because je cant be here.

If it is general visitor then, they have to be able to demonstrate they can live independently and show the funds, that is all.

does this mean that, people on Tier 1 G can not sponcer their parents ?

If a person is on tier1 g, his parents will have to apply as general visitor because new rules say that only permanent residents can call their parents on family visit visa.

And what happens if parent do not have ample money to support themselves ?

You seem to have missed the point of the discussion which is about sponsorship. It is not about which category of visit visa, as both require the same level of sponsorship if the applicant does not have independent means.

May be .... but following statement

"If it is general visitor then, they have to be able to demonstrate they can live independently and show the funds, that is all."

suggests that such visitors need to show their own funds...

correct me if m (still) wrong

No, means they have to show they have access to funds.
