OCI guidance please!

Post by ang3l.in.paradise » Sat Apr 06, 2013 9:17 pm

My Husband is french and son (7months old) is british.I am indian.
I wish to apply for OCI for them both as we would need to travel to India frequently(at least twice a year for 2 weeks).
Can someone please guide me if this can be made on a single application and the process?

None of you qualify as per elligibility for OCI, if you have Indian passport.
If you surrender you Indian citizenship then only your son will become elligible for oci, including yourself.

And your husband if he doesnt have and Indian roots can not apply based on spouse elligible for oci.

Perhaps some more reading on HCI/CGI websites for oci willl be more useful!

Regards.

They can apply for PIO instead of OCI.

My husband was a citizen of India till he was 20 and then gave it up when he became a citizen of France. " A foreign national, who was eligible to become citizen of India on 26.01.1950 or was a citizen of India on or at anytime after 26.01.1950 or belonged to a territory that became part of India after 15.08.1947 and his/her children and grand children, provided his/her country of citizenship allows dual citizenship in some form or other under the local laws, is eligible for registration as Overseas Citizen of India (OCI). Minor children of such person are also eligible for OCI. However, if the applicant had ever been a citizen of Pakistan or Bangladesh, he/she will not be eligible for OCI." This makes me think that my husband and son are both eligible for OCI.

ah! that's a critical piece of information.

Not sure what you mean't by single application - refer to HCI website for OCIapplication process.
