Non EU fathers/mothers of Irish born children not resident

Post by missirish » Sun Apr 07, 2013 5:07 am

Hi folks
I was conducting some research last night and came across the following article

ECtHR Confirms Child’s Interest in Establishing Paternity, Parent’s Right to Enforcement of Visitation

http://www.ijrcenter.org/2013/02/06/ect ... isitation/

Not sure as im not legal minded and cant get my head around legal jargon and such .. but would these cases have implications for non eu parents of irish children to be at least allowed visit visas to see their irish kids.

article 8 of european law includes the right of a child to an identity.

In ireland, for a voluntary acknowledgement of paternity, Ie to put his name on the birth certificate, the childs father must be present to put his name on the birth cert .

article 8 also makes provisions for children to be able to have regular contact with both parents, so would the second case mentioned in the above article have implications ??

These are recent court judgements and i just thought i would share them and see what the response would be ..

maybe im jumping the gun a little !!! as i said im not legally minded hahaha

You probably won't find an answer to your questions on this forum, majority of members on this forum are not legally minded as yourself, and are best at interpreting the laws and articles that are written for the comprehension of those who aren't familiar with the legal books except for few.

You will need to contact a lawyer and relay your findings to him or her in other to prepare him/her to conduct his research before deciding to take on your case.

You won't get answer to judicially complicated matters of this type on this forum.

Good luck
