My PSW visa will be expiring in August 2013. I need your advice before I apply. I am new to this forum but I have seen here that other members help others in their visa queries. I am confused how to apply i.e. whether to join as a director in my brother existing company in the last three months or form a separate company.
If I join my brother's existing accountancy practice (he applied Tier 1 entr on this company as well and is still pending) then this will save some costs i.e. I will have contracts, website, adverts, business plan etc.
What do you all propose should I join him or not?
Second Question;
I need practicing certificate to open my own Accountancy practice or to join any other practice. I can easily get Practicing Certificate from AAT or from ACCA. AAT Practicing Certificate will be issued in 2 to 3 weeks while ACCA is just like the Tier 1 entr means you cant anticipate the processing time it can be a week to several months.
If I take AAT practicing certificate (PC) then it will be a waste of money as I have to take the ACCA PC as well.
Would UKBA look critically that earlier my brother has applied and now I am applying in the same company. Our current practice is a very profitable practice. I believe UKBA is looking on the Genuineness of Businesses not just opening another company when I dont need it.
Third Question
I will be submitting my wife's application with me as well as my dependent. To my knowledge only the Main application was the only form I have to fill in both for me and my wife. I just looked UKBA and came to know I have to complete a separate application form for my wife.
The form has an address to send to. Do I have to send it in a single Envelop or a separate one.
Forth Question
Maintenance funds.
I am maintaining £1500 for me and wife. The are held in my UK Bank under my name only. Do I need to have £600 to be in my wife's account (she do not have any bank account yet) or in mine would be sufficient?
If they are send in two separate envelops, do I need to obtain two copies of bank statements one for me and one for her.

2. What are your qualifications? You do not need Practicing certificate to open accounting practice as long as you get register with HMRC under MLR 2007 OR unless you are member/student of ACCA or AAT then ofcourse you need to get one first. However it will make your case strong if you get one.

I know that I do not need a practicing certificate to open an Accountancy practice in the UK. I am a fully qualified chartered certified accountant. I can easily take PC from ACCA or AAT or IFA etc. But the question is the time frame. ACCA takes much longer and if I apply today it will take several months. However AAT takes 2 to 3 weeks.
I am still waiting for replies to my other queries.

I am not arguing but based on my scenario, can I join the exiting company. If not, is there anything in the law which stops me by joining.

If you are confident about the fact that you are joining the same business and will be able to convince UKBA that
1. this 50K you are investing is not the same as 50K your brother had shown earlier to invest in the same company
2. You are bringing your own clients to the company, (new contracts etc.. )
It doesnt sound like too good an idea when UKBA is already pending one application.. (bbut again they are just stuck on all applications and not just your brothers)
You could probably justify by saying about the amount of money you make,. but I am not entirely sure as I haven't heard about anyone in this situation. Wish i could help a bit more ..
Question : Why didnt think of applying as a Team ?? Would certainly have made things a lot easier in your situation
