ILR on PBS- Dependent Visa Query

Post by growler » Sun Apr 07, 2013 5:59 pm

Hi All,

I'm slightly confused as to the best way forward with my upcoming visa application, hence this query. This is my first post here, I'd appreciate some help and guidance!

In August this year I complete 5 years on PBS (Tier 1 General) which allows me to apply for ILR.

I got married in November 2012 and my wife joined me in the UK in the same month. Her visa has a validity equal to mine (August 2013).

1. I was considering applying for ILR as main applicant with my wife as dependent by completing form SET(O). Is this the right thing to do or are there any other options? I have seen some people mentioning FLR(M) however I'm not sure what the differences between the 2 are when it comes to dependents.

2. Does my wife have to provide 'Life in the UK' test in order to qualify as my dependent?

3. I understand that I would need to provide letters from my employer for any periods of absence including annual holiday. I have been contracting through my own limited company for 5 years, does this mean I can provide my own letter for this?

4. The documentation I have planned/obtained for my application are:
--12months Payslips and Bank Statements
--Marriage Certificate
--Cohabitation Proof (Joint account or House contract showing both names)
--Explanation of absence including proof like flight tickets.
--Employment contracts from the last 5 years

Do I need any more documentation?

Thanks for the help.

To include your wife in your ilr application, your wife has to live with you in uk for the last two years.

Thanks alanwong. Which category will my wife fall under in that case? Also which form will she need to complete? FLR(M)?
