Sharing for the benefit of whomever may find it useful and for the cause of this forum which I found very useful!
So I got ILR after 5yrs on WP last year but I could not include my husband as dependent as he was travelling. He travels frequently! I am telling you this man has gone through 3 passports in just 4yrs! His absence days may have been over 700 we did not even attempt to document them. However, he has not been away for more that 6months in a block just three weeks here, one day here, but he is never in the UK for more than 2 months without travelling. He is a human right lawyer and travels across the globe on work.
So almost a year after I got my ILR he got a window when he is not required to travel for a month and we thought to put in his application for ILR too. I was advised here that the correct form to use is SET (O) not SET(M) and to select OTHER then site Rule 196D(ii).
We arrived at Croydon for 10:30 appointment, got thru security, then form checked and stamped VALID on the ground floor, when to 1st Floor and paid then we were called to Window 13 where a woman asked for the form and payment receipt and then my ILR, she entered something on the computer than gave us the form back and said we should go to 2nd Floor, no explanation.
We got to second floor after 2hrs my husband was called to Biometrics window 30 where they took his fingerprints and photo. We waited another 1,5hrs and were called to window 44 and asked to hand in everything we had, no questions. The man just put in everything in a plastic pocket and he also collected applications from 3 other people at the same time as hours. After an hour waiting we were called to window and again no questions or explanation handed back all documents and passports with letter on top and we were told that we will get the Biometric Card in 7days. This was Tuesday, the card arrived on Friday!
Here is what we put together with the application:
- Form Set (O) ticked other
- Reason 'Rule 196D (ii) spouse of settled person formerly WP holder
- Current visa Work Permit Dependant'
- Letter from me confirming marriage, cohabitation, children etc
- My passport and ILR Biometric card
- His 3 passports
- our marriage certificate
- birth certificates of our 3 children all born in UK
- council tax bills from last 5 yrs in both names
- his bank statements 6months
- letters (my name only) from my bank from 2011, Gas and Electric Bill
- letters (his name only) from bank
- Joint letter (both names) from our daughter's school
- letter from his employer from when he applied fro US visa last month confirming travel
- letter from him saying he is human rights advocate and travels frequently to places like Slovenia, America, Chile, Uganda, etc and sited just 7 such visits and that they are too many stamps in passports that it is not feasible to give an accurate account
- letter that as Dependant he is exempt from continuous residence requirements (note that his visa was prior July 2012)
