Eea2 application for extended family member

Post by nidaulhaque » Sun Apr 07, 2013 11:43 pm

i have very complex question, plz help with this.

i am German national and also got PR card sticker.
My husband is Pakistani national and he got residence card.

my husband's aunt is currently here on 2 years family visit visa. which was sponsored by my husband's brother who also lives with us same address.

now i need to prove two major things if i apply for her residence card.

relationship and dependency???

i can prove relationship that's not a problem. but is she comes under extended family member? she is my husband's mother's sister.

now dependency, i am not sure how to prove this? i sent money to her just once about £4000 while she was in Pakistan, will this be enough?

no my questions are.
1. can i apply for her residence card on eea2?
2. if her visa expire after applying eea2 will she have to leave?
3. if they refuse eea2 will be any chance to win appeal?

It seems like you have very minimal proof of pre-entry dependancy or membership of common household, for which you will wholly or mainly in charge of. In those circumstances, it is difficult to evisage a successful application, going by the law, caselaws and rules.
