fiance visa refused-apply for visitor marriage visa

Post by bridetobe » Mon Apr 08, 2013 2:44 pm

My application for fiance visa was refused because my sponsor is currently working abroad and has no job offer in uk during the application.
1) Can i apply for visitor marriage visa to proceed our wedding plan then apply for spouse visa once he get a job in uk?
2) Can i still visit uk as tourist after fiance visa been refused? what are the documents required to convince the IO that my visit is for holiday and to rearrange our wedding. I will be travelling with my fiance.

After the refusal of a settlement visa it is very difficult to be granted a visit visa. You have stated your motivatation and desire to settle in the UK so your strong ties to home and motivation to leave the UK after a visit are somewhat compromised by that. You would have to present a very strong case for your ties to home for a visit visa to be granted now.

Thanks for your advice. Forget the visitor visa I will make fresh application of fiance visa and provide the necessary docs.

About my question 2, I will bring some docs to avoid refusal entry at the border such as :
1) Letter from employer to confirm that i will resume to work on certain date
2) Paid return flight tickets.
3) Saving passbok showing balance of gbp 6K
4) Latest mortgage statement to prove that i have strong ties to return.
5) Expired receipt of provisional booking for marriage to prove that my visit is not to get married but to rearrange our wedding.

Since my fiance will be travelling with me, he will also bring same docs to prove our purpose of visit. Besides, we need to gather his latest income/savings statement and other documents for my next application.

Are the above docs suffice to grant me enter UK as tourist?

There is a risk of refusal and it would be better to apply for a visa in your country before travelling. That way, the ECO can sit at his desk and make an assessment of the risks in his own sweet time with all the evidence you have provided.

If you arrive in the UK without a visa (you must not be a visa national), you will be pulled out of the line and made to wait, you will be interviewed, you will be delayed, and you may be refused (depending on the quality of the answers you give to the various questions). You can avoid all of this by knowing if you have entry clearance before you travel.
