Tier 2 refused after Re-apply

As i apply my tier 2 application out of time. My student visa was expired when i applied for tier 2.
Reason for refusal
As you have not met the requirement to switch into the tier 2 category because you submitted your application without valid leave as a student, your sponsor is not exempt from the RLMT.

I am waiting to get my document back

My question.
1. My visa already expired and i am going back to my home country. Can i apply from my home country?
2. My employer is ready to do RLMT.
Really appreciate for any reply

If you have overstayed by more than 28 days it's unlikely an entry clearance can be issued.

I think that they changed the overstay limit in 320(7B)(d)(i) from 28 days to 90 days for entry clearances.
