Help Needed on Returning Resident

Post by Vikas_K » Wed Apr 10, 2013 2:30 pm

Hello,

I am from India and arrived in the UK on work permit in December 2002. I got my ILR ( Indefinite leave to remain)

in September 2010. But due to project requirement I had to travel back and work for my parent company in India. I left UK on December 31st 2010.

In these 2 years time after my ILR was issued I did not travel to UK and hence my ILR got expired. But oppurtunity

arose in March 2013 to work in the UK from the same company and my company applied for ICT ( Intra company Transfer, Short term) in march 2013. I arrived in the UK on 17th March 2013.

I want to know the following:

1.Can I renew my ILR from inside the UK.

2.After the current assignment, Can I leave the UK and apply for visa as a returning resident.
My company has offered me UK employment.

I still work for the same company and interested to settle in the UK.

Thanks in advance.

Regards,
Vikas

Unfortunately, if you entered the UK as a Tier 2 (ICT) holder, then you are no longer a returning resident and cannot settle.

Can I still gain entry to UK as a returning resident if I apply for visa from ouside the UK (india), provided I leave UK after ICT expires.

Unfortunately, no. 18(i) fails because of your current Tier 2 (ICT) status.
