ILR, apply as tier 1 or hsmp?.

Hi

I am about to apply for my IlR in late April, however I am confused about a couple things and any help would be appreciated :D

I was granted my HSMP visa in Jan 2008 and entered the UK in May 2008, I then was successfully granted the Tier 1 General on the 23rd of April 2010 and my current visa expires in May 2013. However I am confused on a coup,e points in the ILR application form (SET(o))

1. Should I be applying as a tier 1 applicant or an HSMP (5years and not under the ruling)

2. For the section of claiming points, should I be claiming points for earnings under the rules in place before the 6th of April 2010 or after the 6th of April 2010 as at the time of the rule change I was still on an HSMP but the application form does not mention HSMP and only talks about Tier 1.

I am highly confused and unfortunately the UKBA helpline was not able to help either as the person who answered my call was just as confused as I was and suggested looking online to find the answer!

I am hoping someone can help me, my appointment is in a couple weeks time.
