You have to apply for PBS dependant leave from outside the UK. Given that it is her intention to switch to Tier 1 (Ent) inside the UK, what is your wife's current immigration status?

So, does that mean the capital sum for the business is fronted by an approved venture capital firm or Govt funding agency? That would be the requirement for T4 switching.

So, if she does comply with para 22 of the policy guidance (and good for her as it's not the easiest way of raising money), she can apply inside the UK, and then you can leave and apply from your home country.
