How can I come back to UK?

Hi guys, need help. I applied eea2 ON 16TH Jan, 2013 and I am still waiting for my RC. I need to go home early June for a very important event. Can anyone tell me if I ask my passport back, How can I come back from China? Do I need to apply for European Family Permit to enter UK? if so, does it easy to get? I think I only have half chance receive my RC before early June. Thanks.

It all depends on your EEA national spouse employment status here. If they can prove beyond reasonable doubt that they are "Exercising Eu Treaty Right", then I will advice you to ask for your passport to be return. When you get back to China, you can withdraw your application for RC and apply for FP.

you do not need to withdraw the application for a RC... - the EEA family permit is entry clearance, and can be obtained within days... the RC can take up to six months...

obviously, you can be resident within the country and still travel abroad... - hence the reason EEA applicants can request documents back and it will not cancel their application unlike applicants under uk immigration rules.

That would require making two applications. The OP may need the documents used for RC application in other to apply for FP. http://www.ukba.homeoffice.gov.uk/eucit ... /applying/

They can ask for all their documentation back, not just the passport.

this is correct!

I have finally received my passport, and my kids passport and their birth certificates back today.

Unfortunately, and im not supprised by this: my wifes passport and our marriage certificate were excluded from the return. without explaination. (yet another letter of complaint to write)

The letter accompanying the return indicated that they are aware of the requirement for the documents to be returned (my work/business travel to ireland).

the letter notes that the application will proceed and she will hear about the result "in due course".

but to clarify, not only return of passport - they need the originals at first to verify authenticity (a quick process!) they can then copy the documents, stamp them as genuine copies... and return the originals.


I have also asked in regards to obtaining a EEA FP in the UK before travel abroad... waiting on their response (if they decide to)...
my request relates to zambrano... but it should be the same principle as any other EEA documentation...
