ILR 28 days rule and five years period calculation

Hi,

I will be due for ILR towards the end of 2013. I want to make sure I apply on the right day.

I got Tier 1 (General Visa) issued on 17 NOV 2008.
got Tier 1 (General extension) issued on 08 DEC 2011 valid until 08 DEC 2013.

My five years on tier 1 visa will be completed on 17 NOV 2013. My understanding is that I can apply, for ILR, by post or in person, 28 days before 17 NOV 2013, which will be 20th OCT 2013. Please confirm if this is correct.

I am living continuously in UK since Feb 2006.

All,

Can you please confirm what entry should we make for the Number of years spent in UK.. if we are claiming the delayed entry concession..

EC stamp date: 2nd May 2008
Entry in to UK 2nd June 2008..

Should i calculate time spent from 2nd June or from 2nd May..

Thanks Kevin24, In that case i would have spent only 4 years , 10 months and 17 days on the date of application.. should i write a cover letter to explain that i am claiming the duration between EC clearance and entry for 5 year calculation?

From 2nd MAY 2008.
No need to write any Cover Letter. When they key in, your Passport details into their system,it will show how long you have stayed over here. Don't complicate your case by writing letters.

Hi techie78,

3-month entry concession - The period between entry clearance being issued and the applicant entering the UK may be counted toward the qualifying period, as long as it does not exceed 90 days. This can occur if the applicant is delayed travelling to the UK. Provided the period of delay does not exceed
90 days, it will not be counted as an absence.
