Long gap (WP - Tier 2 ICT) Applying for ILR

I entered UK on WP in May2008 and stayed till Nov2009. Let to India in Nov2009 and returned back in Feb2010 on same WP. There is a gap of 82 days in the residence. During this period I was not paid UK salary and I was only paid Indian salary in India a/c. During this gap I got married and my mother has a surgery. So I will be showing this gap as serious and compelling reason. But my query is if this gap breaks continuity in UK? Though I returned back in Feb2010 on same WP and since then had extension as Tier 2 ICT whilst in the UK.

Dear technoguy,

You should be all right with this gap. Please note that since the recent rule came in effect from 13th Dec'12 relating to absences even if you apply on compelling ground you will need your employer letter mentioning all your absences (including annual leaves, if any), hope you can manage it.
Also, try to span your 5 consecutive years backward from the date of application and if your total absences for an year is 180 days it should be all right as per new rules.

Thanks. My employer is not willing to give any absence letter. So for the absence I have I am thinking to classifying them as 82 days (compassionate reason with marriage certificate and medical certificate), 32 days (As annual leave with payslips for that month), 3 days (As annual leave with payslips for that month).
