Application of Tier 2 ICT

Hi Experts,

Need an Advice.

"I was granted a visa dated 23/07/12 valid until 31/10/12 under the category Long Term Staff Migrant.However I did not travel and visit UK under the same visa and the visa got expired on 31/10/2012

For a long term assignment starting May'13 I will have to visit UK please suggest what shall be the procedure of applying for the visa now.Mine would be a company sponsored long term visa.

So can I reapply for a visa, as in the UK Border agency rules for Tier 2 long ICT Intra-company it says for one who has stayed in UK with such visa can only apply after a cooling period of 1 year. Does it apply in my case as I have never visited UK.
