Dependent on ILR applied after expiry

Post by rockall81 » Fri Apr 12, 2013 8:33 pm

Hi,

One of my friends wifes dependant visa was applied 1 day after the expiry.

We went through a consultant called sk*llcl**r and he went on a holiday for 10 days, which caused loads of chaos as there was no one else to look after the application. Total disaster. anyway wanted to know what will home office do in these type of cases..

Thanks of advice in advance.

What is your friend's immigration status, and what was his wife's status before applying? What application was she making?

She may switch, if her just expired leave was granted for longer than six months, etc. As she has overstayed, she will be considered under the current rules.

Applying in the UK or outside the UK is both possible, subject to the current Immigration rules.

Your friend should be asking these questions.
