Non EEA with PR flying to Spain without visa neither EEA.

Post by spike_UK » Sat Apr 13, 2013 1:37 pm

Hi guys, I have been in Spain 2 years ago with my EEA spouse(2 weeks holoiday) so there was no issue. My question is, can I go to Spain without visa( for 1 week holiday), my friends gave me short notice we suppose to fly next Sunday(21/04/2013) so I have no chance to get visa within 1 week( the visa is free of charge). should I go without visa? what would be the worst outcome? or should I not go?
Many thanks.
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.
PR dated 05/03/2013

You will need a visa which is not free if travelling without the EEA spouse.

As I understand matters, the OPs is no longer a family member of EU citizen.(Please correct me if this is not the case).

A non-EU national benefits from the terms of the directive if they accompany or join their EU family member. If they don't, a visa can be required of them and a fee may be charged.
