Do i need to show income/Earnings for wife ILR

Do i need to show income/Earnings for wife ILR

Dear All

I am holding a British passport and my wife is on a dependent visa,she came to UK on 19 march 2011

my question is do i need to prove my earning or income ?

as i am confused that whether she comes under old rules that i don't have to prove my income

or does the new rule applies to every one

Hi. Sorry to answer your question with another but it is necessary to clear the air. You are a BC but you say she is on a dependent visa - you really meant to say Spouse visa right? The dependent visa category does not cater for partners/spouses. Or were you on a time restricted category when she came and applied on VAF10/VAF2 and not VAF4?

Assuming VAF4 Spouse:

I believe new rules came into effect 9th July 2012... so she will be under the old rules.

She came to the UK 19th March 2011. She would have been eligible to apply for ILR around the 21st of February 2013. Any particular reason why you havent made the application? Her existing leave should expire around June 19th 2013 or thereabouts - So I'd strongly recommend PEO application rather than postal to avoid falling into legal limbo with leave expiring and not knowing whether they will say yea/nay.

To answer your immediate question - under both old and new rules, proof of your earnings is required for her ILR application. With old rules however, the income thresholds are much lower and flexible.
