Citizenship

Post by milagro » Mon Apr 15, 2013 2:00 pm

@Damanisshallo,

Can you please let me know if I am eligible to apply for Citizenship under the 15 month period since my ILR appliation was completed by UKBA in 7 months and 3 weeks?

Thanks in advance

That depends upon whether you contributed to the delay, or not. For example, if UKBA raised queries and then you took a long time to reply, then you cannot use the concession.

However if you did not contribute to the delay in the ILR being granted, then yes, you can apply 15 months after your ILR application date.

As always, do ensure that you were physically in the UK at the start of your qualifying period, 5 years, or 3 years if married to (or in Civil Partnership with) a British Citizen.

Thanks Dami,

I appreciate your response. I did apply for my ILR on the 10 year long residence basis.

Application sent: 18/08/12
Application acknowledged: 22/08/12
Biomectrics done: 21/11/12
Docs & BRP received 12/04/13--Dated: 09/04/13

So that means I can apply for my citizenship around 09/11/13?

Thanks in advance again

Dami?

15 months after 18.08.12 is 18.11.13. Whether you can apply from then depends upon whether you contributed to the delay in your ILR being issued. For example, between being invited to do the biometrics and actually doing that on 21.11.12, was there any noticeable delay?

Not that I know of. The Biomectric letter was dated November 16 but I did it on November 21st within the 15 day period. All documentation sent originally was accepted by the UKBA

Thought also it was the acknowledgement date from UKBA should be the date considered and not the date I sent!

The law is clear, for a posted visa application, the date of posting is considered to be the date of application.

Compare to ... citizenship applications ..... where the date of receipt by UKBA is the application date.
