There is big incident happened with me. I cam to UK in October, 2010 with validation of 10 month supposed to expired in August 2011. By law, I have applied prio to 3 months in June, 2011 by issuing new CAS latter. I have given biometric within samll period of time. I was waiting for my application to received me back, by the time my college was shut down. UKBA did not inform me but still i obtain a new CAS latter from another institute to complete my study and post it to UKBA. Within 2 weeks I have received my application with refusal of my visa with reason provided that there is more than 1 month gap between my visa expiry date and a new course commence date, where there is not my fault.
I have appealed against the decision and in court judge gave decision in my favor. according to determination I should have receive my biometric card within 14 weeks since the determination promulgated, still i was waiting for my approved visa up to 32 weeks, in the mean time we wrote many latters to UKBA but did not receive any response out of it. After that when i went to my college to let them know about my visa and issue the latter, I realized there is no college any more and i did not find anywhere in the premise of the college. Still I did not heard anything from UKBA and again I paid tuition fees to another college and applied again in Oct, 2012. I have given biometric straight after 1 month.
UKBA says we 100% pass the tier 4 application within 14 weeks of the biometric date. But, today, it has been more than 24 weeks with me, I do not know what to do with these rules and regulation system.
I have paid tution fees to 3 institutes without get any qualification.
I will be appreciate if some one can give me legal advise to follow up with UKBA.
