Extending Tier 2 G visa under rules (updated in April 2013)

I am currently on a tier 2 G visa issued in Jan 2012.

My employer did not need to do resident labour market test (RLMT) at that time because i was switching from Tier 1 Post study visa.

Lets say my employer now wants to apply for a COS to extend my leave (please note the job is NOT on a shortage list) do they need to carry out this RLMT? or am i exempted by virtue of the fact that they are merely applying to "extend" my Tier 2 leave and not employing me on a new job?

87. If you were last granted leave for a job in a shortage occupation that is not at NQF 6 level
(or the equivalent in Scotland) as stated in the Tier 2 codes of practice and the job is no
longer on the current shortage occupation list, you can still apply for an extension, or to do
the same job for another employer. The job will still be considered to meet the required skill
level for Tier 2. If you are changing employer in these circumstances, your new employer
will need to carry out a resident labour market test before they can sponsor you.
