Hi,

I am EU citizen, married to a British citizen for 2 and a half years. Meanwhile we bought a flat, working paying taxes and everything. I know that in normal circumstances you can apply for Naturalization after 3 years being married.
Last year in December I had a drink driving conviction, 14 months disqualified, reduced to 11.
This year in December we have our 3rd anniversary.

How will that that conviction affect my Naturalization? Can I still apply for naturalization after just 1 year from the court sentence?

1. You need to be settled (ILR or PR) in order to apply for naturalisation.

2. Your sentence at court is likely to be classed as a non-custodial conviction and will create an automatic refusal for 3 years.

3. As the offence is one of recklessness it may still prove to have a negative affect after 3 years particularly if you have other offence in the interim.

You must be settled. After 5 years of exercising EEA treaty rights in the UK you will be able to apply for permanent residency.

EEA applications can be refused on grounds of "Public Policy, Public Health or Public Security", but generally a single conviction would unlikely cause a refusal.
