Straight forward EEA2 application?

Straight forward EEA2 application?

After reading extensively about personal experiences on this forum and learning so much from you, I would like to thank you for sharing these with me and seek now your advice/guidance on my upcoming EE2 application.

I believe my application is very straight forward but please let me know if you think I should add more/less supporting documentation.

Summary of my personal situation:
- Chinese national
- PhD student in Oxford since September 2009
- Long term relationship (since 2008) with a EEA national, who is working full time in London since September 2009
- Living together in London
- Current immigration status: Tier 4 visa valid until February 2014

I was thinking to add the following documents in my application:
- 2 ID pictures of myself
- my passport and my boyfriend's passport + my previous passport with my UK visa
- my boyfriend has sent his EEA1 application last month so I was thinking to add his RC with our file if we have received it by the time I sent out my EE2, otherwise we will send it later on as it arrives (is this possible to add supplementary documentation at a later stage?)
- letter from my boyfriend's employer confirming employment + salary + latest 3 payslips
- bank letter from HSBC saying that we have a joint account opened in October 2009
- 1 bank statement from 2010, 2011, 2012 and our latest bank statement with my name and address
- bank statement at same dates with my boyfriend's name and address (showing that we have been living at the same address)
- lodger agreement with both our names (3-year agreement signed in July 2010, we live in a house share in London)
- student certificate from Oxford university stating the date at which I finish my studies
- a letter from my boyfriend saying that we are living together since September 2009
- a 'common law marriage certificate' from the French consulate in London stating that we are living together since October 2009

A few questions on which I wanted to seek your advise:
- I would need my passport by early July. Should I already mention it in my application cover letter or email them c. 1 month before
- Should I leave sections which are blank in the application or can I just withdraw the non relevant section pages (section 2 (family member applying with me), section 4 (retained rights), section 5 (surinder singh case), section 7 (eea national self-employed), section 8 (eea national student), section 9 (eea national execising treaty rights as other qualified person))
- Should we put one or 2 special delivery enveloppes to get passport returned (one in my name, one in my boyfriend's name, although we are living at the same address?)
- as we are in a relationship, I understand I don't have to prove dependency, do I?
- any other proof I should add to the application (holiday pictures, matching passport stamps showing we have been traveling together, or that would make the file more confusing?)
- should I add a cover letter? anything in particular to highlight on the cover letter?

By the looks of it your case is very straight forward as if you have the marriage certificate, your husband exercising the treating rights and you can prove that you been living together and the relationship is genuine with the help of historical photos and letters from the parties you mentioned you will be perfectly fine. make sure you do add the add the recorded envelopes you stated just in case they decide your case early and send it back straight away due to the clean nature of the case.

finally do add a cover letter stating how and when you started living together how he is exercising the treaty rights and you intend further to live together as a happy couple to make it more simpler and precise.

I will not have marriage certificate though as we are unmarried partners.

In terms of logistics, should we put one or two enveloppes for passport returns by special delivery?

If you attach EEA national's EEA1 registration certificate with your EEA2 RC application then only you do not need to send again the documents pertaining to EEA national's treaty rights. But all other documents as you mentioned you will certainly need to send which will be assessed by the caseworker and most likely you might undergo interview too with the caseworker which has become the part of application since 2013.

You will need to provide evidence that you are in a relationship (such as letters from your joint bank account) and not just flat mates for the past 3 years.

Thanks for your replies and advice

I will add a common-law marriage certificate from my boyfriend's embassy stating that we are living together since 2009 and we'll add joint account statements of course to show that we are a genuine durable relationship.

In your opinion, is it necessary to add holidays pictures together + passport chops to show that we travelled together outside EU or it will make it more messy than anything else (and joint account should be enough)? If they need more documentation, they can always request it from us if they believe durable relationship is unsufficiently documented?

Will keep you posted with the outcome/ timing

Process went really fast

EEA2 application sent on 14 May
UKBA received it on 15 May
Passports requested back on 15 May
EEA1 Registration Certificate sent on 21 May (we had not received it by the time we applied)
Passports received on 22 May
COA received on 22 May, dated 16 May
Residence Certificate (on ISD A4 sheet) received on 9 July, dated 2 July

Great thanks to UKBA Euro team for swift and efficient examination of our case
