Spouse Visa Appeal - contact and subsisting marriage

Post by thunderb0lt » Sun Apr 21, 2013 6:16 pm

Hello

I am in the process of helping somone put together documents for the bundle for appeal for pending hearing.

One of the grounds of appeal was lack of evidence of contact. The ECO cited paragraph 281 (iii) of the Immigration Rules. In the application calling cards were provided as evidence. For the appeal we have obtained detailed logs from the calling card company. However I have noticed that the number called is not the same number as that provided by the applicant/appellant in the application.

What is the way forward with this, is it worth getting a letter from the applicant confirming that this is the telephone number used to have telephone onversations with her husband. The husband also went to her country adn stayed their for a month shortly after the application was made.

Many thanks

Well, you are not much use as you don't seem to know what you are doing. Why doesn't the person you are helping get some proper advice first hand? Seriously, you can only make things worse!

What makes you say that I don't seem to know what I'm doing. We will seek legal representation for the hearing, this person will of course put the witness statements, evidence and bundle together. I just wanted to get opinions from people here.

Are you able to comment at all.

Thanks
