Tier 2 ICT. Help please

Hi All,

I was on Tier -1 Visa that expired in 17th Dec, I left UK on 11th Dec.

My employer has an assignment in UK, hence they want to file Tier -2 ICT for me.

Please help me know If I am eligible for Tier-2

If your employer is a registered Tier 2 sponsor they can apply for a restricted CoS and once it is granted you can apply for entry clearance. Before they apply for the restricted CoS they will have to carry out a RLMT (if applicable). Applications for restricted CoSs received by the 5th of a month are decided on the 11th of the same month.

Hi Manci, Thank you.

Please help me understand what is restricted COS and RLMT.

As I was on Tier-1 till Dec 2012, am I supposed to under go cool off period before I apply for Tier-2 ICT.

The T2 sponsor has to apply for a restricted Certificate of Sponsorship if they wish to employ somebody who requires entry clearance, i.e. who is resident abroad. There is a monthly quota for restricted CoSs. RLMT (resident labour market test), which takes 28 days to do, is also needed before the restricted CoS can be applied for unless the job is on the shortage occupation list or the annual salary is £152,100 or more.

As I was on Tier-1 till Dec 2012, am I supposed to under go cool off period before I apply for Tier-2 ICT. no, cooling-off only applies to applicants for Tier 2 General visas who had Tier 2 leave previously.
