ILR with visa gap

Dear All,

I would like to know if I am eligible for applying ILR. Here s my situation

Work Permit - June 2006- May 2008. I was here for a month and returned back to home country.

Entered UK again in June 2007 ( with the same old WP).

June 2007 - Nov 2010 ( WP/Tier 2 ICT)

Nov 2010 - July 2011 (PBS Dependant)
-Here occurs the problem. I had to apply for PBS dependant as my employer ran out of COS allocation. However in order to join the company, they suggested me to apply as my wife's Tier 1 PSW dependant and join the company.I did that

July 2011 - Till date - Tier 2 General sponsored by my employer ( After the allocation were open again).

I understand that my clock reset from the date I switched to PBS dependant. However, my employer is positive in giving me a letter to justify the reason for my visa switching and also support my ILR application.

Will it be possible for me apply for ILR at Senior caseworker's discretion?
