About benefit claim

Pls my people my ex is eea
She start work in August 09, loose
Is jobs December 09 and
2010 January she stat claiming housing
Benefit and apply for JSa too
But regarding JSA by the time
They send letter of sprove she have start work
In April 2010 she just claim for three mont
And they ask her to return part of the money,
Which she have started doing that till last year
And they did not send any remainder letter any
More pls can this afect me if I want to apply
For my own ror or pr because I am
Non eea then am due next year pls let me know pls thanks
Pls am just using this site can you help me about my brother wife
She just doin 15hours a week

Which eea country is your partner from? Did she actively seek employment all the time she was unemployed? Why did they say she must return the money?

They say they notice that her saconstance
Have change and they pay her over pay and me too get my paper
In march and start work in April that why she need to return part o
The money

Sorry I am lost, what exactly are you asking? Are you a spouse of civil partner of the EEA citizen? Are you working or are you claiming benefits and what balance are you wanting to pay, the benefit overpayment?

From france looking for those time but we have little mies
Understanding that time that why she decide to go ahead
And claim but she used one of her friend address that time
She did not used our adress so that I will not know
And use new bank Ac too so that any statement will
Not come in so I will know she is getting that but she used
Our address for jsa and but HSB and jsa come to our adress
When they stop the HSB and approve the JSA and ask her
To pay part of of it back I thinks they see that hv start work
That is why they ask her to pay the money back and she hv
Not contribute much I thinks so but she is paying the money
Installmentaly since then and stop it again and they wright
To our new adress that we move to that she need to the balance
Last year but pay it hv not finish it yet what did u thinks
Did I need to pester to complete they money because we devourece
Now but we still see each time and I want to apply for ror and due for
Pr next year pls advice what to do thanks

My partner overpayment HSB that is what am asking about
And she is from france but just working 15hour a wek
But me as husband working full time but we divource now
Just want to know if is not going to afect me when I apply
For ror or pr or should tell her that she need to pay the balance
That is what I want to know

I think I have the gist of this now. You separated, she moved into a new address and started a new claim. I gather that an overpayment started either because you still had an active couple claim or they are arguing that you were a couple and that you were working and thus not entitled to JSA/HB?

If it was a couple claim you are both liable for the overpayment and you can send a financial statement to make an offer of payment, they usually accept this especially if hardship can be shown. If the overpayment is in her name then it is her responsibility and you are under no obligation to pay this unless you want to.

For PR providing you have had 5 year continuous residency in the UK with the right to reside this should prove no issue, unless you receive a conviction for benefit fraud, even so it's unlikely to cause a refusal as the crime will have to be, generally, serious to have a refusal under EU law.

If you were married for 3 years and then divorced you can still possibly continue to have the right to reside and can still be eligible for PR after the 5 years.

Further clarification on divorce and retaining the right to reside:

The case of DIATTA (ECJ 267/83) established that a spouse would not cease to be a family member in the event of marital breakdown/separation until such time as a divorce was finalised (Decree Absolute obtained).

Following the 2006 EEA immigration Regs, here are now a number of circumstances in which non-EEA national family members can remain in the UK even if their marriage breaks down.

There are certain circumstances in which you may retain your right to remain in UK under the EU regulations:

A person who ceases to be a family member of a qualified person on termination of a marriage or civil partnership will retain a right of residence if:
• the marriage or partnership lasted for at least three years immediately before the initiation of proceedings for divorce, annulment or dissolution, and
• the parties to the marriage or civil partnership had resided in the UK for at least one year during the duration of the marriage or civil partnership, or
• the former spouse or civil partner of the qualified person has custody of the children or a right of access to the children in the UK, or
• there are particularly difficult circumstances (such as domestic violence) justifying the retention of the right of residence.

In such circumstances a family member retains a right of residence if:
(a) S/he is a non-EEA national but is pursuing activity which would make him/her a worker or a self-employed person if s/he were an EEA national,
(b) S/he is a self-sufficient person, or
(c) S/he is the family member of a person in the UK who is either a worker, self-employed, or is a self-sufficient person.

So provided you have been in UK for a year or more, and you or your partner is in one of the categories listed under (a) to (c), you may be able to stay.

If you retain the right to reside following the decree absolute then you should be able to continue to claim benefits.

Providing you meet the above, as you are working, you will have a prima facie right to reside and should be able to get your PR after the 5 year period.

Know we just Seperate this year she claim those benefit during
Our married time but am not working during that time
And she too lose her jobs December 09.
And she just claim for three month in 2010 01-02-03 then
Start work April10 till now, but I never claim anything since we married
I hv been working since I get my paper and we married for 3-7month
Just want to know if those claim she made is not goin to afect
Me by time I apply for ror or pr
