UKBA investigation... Help!

Post by WebOfDeceit » Fri Apr 26, 2013 10:00 pm

It seems someone very close to me (person A) asked a business associate (person B) to lie and say someone from outside the EU (person C) was coming to do some training in his company. This was untrue, but the associate did it as a favour to his friend so as not to arouse suspicion from family. People in the company went along with the lie and visa was granted.

Person C came to UK but didn't even step foot in the company offices. Person A told family that Person B had to go away on business so he was looking after Person C as a favour...

The UKBA seem to have their suspicions and visited the company to do an investigation. On the authority of Person B the workers have continued with the lie and further compromised themselves.

It all now seems very messy, not least because A has emailed B (on company server) apologising for putting him and workers in this position as he asked for the favour in the first place. Person B has gone all high and mighty - saying UKBA are out of order etc but this is one big mess.

Person A is now thinking of coming clean to UKBA. Person A is worried about the implications for Person C,

Does anyone know if UKBA will come down hard on Person B and his workers? Or are they all culpable.

And if Person A wanted to sponsor the applicant in the future, would any future visas be refused?

Any help greatly appreciated!

really messy mate, I suggest person A to seek legal advice from professionals. Do you know the case about Chris Huhne and Vicky Pryce?
Both were sentenced to several months of imprisonment for perverting of justice.

Yes my worry is that its very serious. Person A realises the error of their ways now there are more people in danger of getting into serious trouble.

Person B is offended that the UKBA are questioning the sponsorship but at the end of the day it was a sham and Person A thinks B's attitude could make things worse!

I can't find a number for the UKBA to ask them direct and was hoping someone on this board would be able to advise.

My point is that person A does not want to get into trouble himself or herself.
However in the first place person A worked with person B together to cover up things. If person A reported this whole thing to UKBA, I am afraid that person A might get himself hurt as well. Because he or she was part of it.
Hence strongly recommend person A seek legal advice from professionals.

I completely agree and Person A is under no illusion as to what an absolute fool I think they have been...

The way forward will depend on what the consequences here may be......

If the UKBA will say, Person C is gone now anyway so we'll just cancel the licence for Person B to sponsor people in future then there's no point in everyone worrying themselves....

But if the UKBA take his extremely seriously (as I think they should) and are likely to pursue this further then I think coming clean is always the best option.

I can't find any references to similar cases online either.

Silly people.

Well, the sponsor company is likely to lose their sponsor licence if the UKBA find them guilty of sponsoring someone incorrectly. And the overseas national would be liable for deportation plus a ban on coming back.

Thank you Station Agent. I think to mess the UKBA around with further lies is playing a dangerous game for all concerned.

They tried to circumvent the rules. The UKBA have felt there was cause to investigate. I think now is the time to admit it was a fair cop and not to make things worse!!
