Tier 1 entrepreneur, baby born while in UK?

Post by seasky » Sat Apr 27, 2013 10:04 am

This may be answered elsewhere ( a link would help)

I expect a baby to be born in a few months here in UK

1. Baby can live in UK initially?
2. To travel must get passport from home country consulate ?
3. If I leave the country even once can baby come back prior to completing visa application for baby? Can baby come back 'as a tourist' (within the normal rights of tourists of home country which is outside EU but needs no tourist visa for UK)?

1, 2: Yes
3: A visit application will likely be refused if both parents have residence permits to live in the UK. How you would fare by asking for visit entry clearance on arrival is not certain in the case of a child, but I would not risk it. Clearly the child is not visiting the parents that he or she is living with!

The visa application process (need to start learning that) obviously take some time. Is there no 'workaround' for a 'visit to grandma and grandpa'?

You can try and it's unlikely they will refuse a child and not the mother. However, it's completely contrary to the immigration rules to permit a visit entry where there is no clear sign that it's a visit. You have sole responsibility for the child and you live in the UK.

Lucapooka, much thanks for your responses. Are there experiences/case studies on this situation? Are there ways to simplify the task (like asking for initial permission for a 'visit' or having a return ticket to home country for mother and baby for say 2 months later. Either of this indicate 'visit' and not living)
