ILR and Entry clearance and 28 days

Hi all
I would be greatful for your help:
TIER 2 General
Entry clearance 08/11/2009
Date of arrival. 09/12/2009 ( less than 3 months rule ).
Date of Expected ILR application 11/10/2014 ( 28 day rule ).
My question could I apply for ILR by a premium service on the 11/10/2014, because my total stay on the date of application by a premium service will be 4 years and 10 months?

Yes.

I applied at 4 years 11 months on last Friday and got it!

Sorry the other question was, will it be ok to get the privilege from the 2 rules ( 3 months entry clearance and date of arrival + the 28 days rule )?
