resoan of refusal

Post by amro » Sun Apr 28, 2013 8:34 pm

any way after this bloody contact with embassy interviewer i got Refuse  although what i told you ( about put 12000 £ + CAS ). all to get ACCA
i have gotten refuse because of her point of view as following : (that I think she was calling another one)
1- you were asked a series of question in connection with your plans to study in United kingdom to establish whether you were a genuine student as required by paragraph 245ZV(K)
2- i am not satisfied on the balance of probabilities that you are a genuine student
3- i am not satisfied that you have shown a credible income source to fund the full cost of your course , your studies in the United Kingdom ( including living costs) are estimated to exceed both your annual income and the sum of you personal saving
4- am also mindful that you intend to resign from your employment in Egypt and that will be necessary for you to sell your car in order to finance your studies .
5-i have seen no evidence as to how this course will have any benefit to you on your return to Egypt.
6-i need you have been unable to explain in any cogent manner how your personal circumstances will be affected by your chosen course of study
7-as a consequence i am not satisfied that the financial outlay on these studies is commensurate with your personal circumstances or with any benefit you might hope to attain from the course
8-i am also mindful that your behaviour and repetitive answers at interview gave cause to suspect that you were actually reading answers from a " crib sheet "
9-also note that you were unable to answer a number of very basic English question ????
10-this was exemplified by the fact that the majority of your answers bore no relation to the question that had been asked by the interviewer
consequently i have cause to doubt that you will be able to follow a course of study in the United Kingdom at NQF Level 7
11--consequently , i don't find your intentions credible . in all the circumstances it would appear that your proposed studies are merely a means of gaining entry to the United Kingdom for other purposes
i therefore refuse your application under paragraph 245ZV (K) of the immigration rules
kindly , i asked for the following :
1- what about Administrative Review are they put it in the consideration or it's uselessness ? and can i attach anew statement with another 10000$ .
2- can i get another Cas from the college
3- have i continue or after this her point of view , they will refuse me again without any reason
4- what i have to say in Administrative Review to change thier point of view in the next interview ?

thanks a lot and waiting for reply

You have to address all those points raised by the embassy.

You will have to address sufficiently all those reasons given which led to your refusal if you want to go for administrative review.

The things you have to prove are that your will be genuine students, you have more than enough money to maintain yourself while studying in UK, How you course will be of benefit to you and your country, why your behaviour seems repetitive and bear no consequence to the questions, is there a reason for you to return after your studies, (e.g family, investment, jobs). In a words you need to show you meet these student requirements as per under paragraph 245 ZV(k).

Read here for further details

You might want to find a competent immigration adviser to help you with address these point if you are not sure what you need to do. Call few competent lawyers and have chat with them to ascertain you chance of success.

If you feel you can address those reasons for refusal in sufficient manner go for it.

ok, put have i get another CAS ? because my university reply was as follow :

( As you have been refused for not appearing to be genuine, you need to change the reasons you were refused for. Refusal suggests that your answers at the interview were inadequate, therefore you need to sort this out. I talked to compliance team and they suggest that if you do a pre-course in your home country, it would strengthen your case significantly. Compliance have to assess whether the things that caused your refusal have been sorted, and until they approve it, you can’t be issued with another CAS Letter. )

what's your opinion ?

As i have pointed out to you in my previous post you definetely need to address the reason for refusal. You can do two things go for admistrative review or follow above instruction of university compliance team.

If you want to go for Admistrative review you must make sure you make all effort to remove all doubt that you are not genuine student. You need to answer why in the interview your behaviour seems odd. Were you nervous or not feeling unwell and all other questions.

Altenative you can try other universities in other countries e.g US, Canada, Australian, New Zealand and European countries if you feel that you can't address those issues raised. It is for you to make decision. Goodluck.
