Very worried and need some urgent advice

Very worried and need some urgent advice

Hi,

My girlfriend is from Hong Kong, she holds a BNO passport as well as a Hong Kong passport. She has been studying in the UK and intended to continue studying in the UK, for which she has been granted a new student visa.

My girfriend is now pregnant. We now intend to get married. I though have been previously married and in the process of getting a divorce. Although this is taking longer then hoped there is no reason now why it should not go smoothly.

I have gone with my girlfriend to Hong Kong to meet her family. I am now very worried though that if we re-enter the UK before I am divorced and we are able to get a fioncee visa that this will cause serious problems when we are free to marry and try and apply for the spouse visa. She would like to continue her studying but it's not clear exactly how practicle this will be particuarly as she has been feeling rather Ill due to the pregnancy.

The baby is now due in about five months, I really should have sought advice from a solicitor before we left but have had so many things to do and things are happening so quickly(with regard to baby).

We love each other very much. I am really quite scared that we are going to encounter problems that will prevent me from taking care of her and our baby.

Any advice as to what to do would be greatly appreciated. We have a ticket to return to the UK within a couple of weeks.

Hi r486,

I don't think that you need to worry too much, as long as she is able to stay in school (thus fulfilling the requirements of her student visa). Even if she does need to take time off, she should perhaps take a leave of absence so that she's still officially enrolled in school and is just resting because she's unwell.

I was in the UK on a Working Holidaymaker visa when I flew to the USA with my British wife and got married there. I reentered the UK on my Working Holidaymaker visa and then applied to have the visa switched to a spousal visa. It took a few months but eventually came through without any problems. I subsequently got ILR and am now in the process of becoming a British citizen.

Good luck. I hope your wife's pregnancy becomes easier too; the later stages are often easier than the first.
