UK settllement visa, sponsor working overseas

Post by blue72 » Sat May 04, 2013 1:33 pm

Hi to all,
I need an advice, comment or suggestion. My husband is currently working overseas. Married for 16 years. We decided to move back to UK with our 2 children (both British citizen) because they need to continue their education there. My question is , my husband will continue working for his current employer for further 2 years. His job is 28 days (work) and 28 days (holiday). During his 28 days holiday he will go back to UK.
The rule on financial requirement, that we need to meet are:
1. First, the applicant‟s partner must be in employment at the date of application and have been with the same employer for at least 6 months prior to the date of application. They must have been paid throughout that period of 6 months at a level of gross annual salary or income which equals or exceeds the level relied upon in the application. 2. Second, the applicant‟s partner must also have a confirmed offer of salaried or non-salaried employment in the UK, starting within 3 months of their return.
We are on the category of Overseas Sponsor returning to UK. But the difference is my husband will still be working overseas (28 days) and when he is off, he will go back to UK. This means he has no confirmed job in the UK but instead continue working abroad.
We meet the financial requirements. My worry is the confirm job in the UK, but as I said he is still employed.
I hope someone can help me on this matter. Should I go ahead with my application. What are the chances of my visa will be refused? Thank you.

Where is he working? What type of work is he doing?

Hi Vinny, thanks for the reply.
He is on oil and gas industry on a fixed term contract and had just extended for further 2 years.. He works in Bangladesh and has been there for 5 years now.. We don't live there, he just goes back on his 28 days (off work) to where we live (asian country).

We have all the financial supporting documents. We have a house (owned) in the UK where we intend to live. My only worry is the confirmed job in the UK which is a part of the requirement. I know our situation is out of the normal rule but if he is still working (if the visa will be granted) when we go to UK. It means he can support us and don't need to rely on public funds.

Another problem that we might encounter is he hasn't been back to UK for 9 years.

I don't know what approach, we will do to minimize the risk of the visa getting refused. Or do you think we don't have chance at all? Please help.

I think that it may be very difficult, if he is working in a non EEA country overseas and will only be spending his holidays in the UK.
