FLR (M) - Section 6 Question 6.9

6.9 Have you lived together permanently in the UK with your sponsor since your last grant of limited leave to remain as a partner? yes / No

Hi, My wife is making an FLR(M) application, she is currently on Tier 1(General). Could you please advise what would be the answer to the above question. The last grant was under Tier 1 General and not as a partner.

Please advise.

On section 5.5 Have you ever been refused a visa for any country, including the UK? - Yes / No

My wife`s tier 1 (general) initial application (applied 2010 from the UK) was rejected, then this was granted on a later date after appeal through tribunal. She was a student when she made the initial application.

Do I have to say YES and explain that there was a rejection or answer NO.

Please advise.

Technically, if you win an appeal, the initial decision is set aside and reconsidered or supplemented, in this case with success. You could indicate that you were refused then put in extra information that you won the appeal and the refusal was overturned.

With reference to this question, would the return of the applicant to their country of nationality for a three month period need to be declared?
