Baliffs letter for PCN - ILR next week, please help !

Baliffs letter for PCN - ILR next week, please help !

Hi all
I have received excellent help from this forum before, hoping I will get valuable advice this time again. I am due to go to Croydon office for ILR on 17-May-13. Unfortuanately, I have received a letter "Notice of Removal" on last friday (03-May-13) from Bailiffs acting for Newham council for a PCN in 2011.

I was not aware of this PCN since it was for an contravention (driving through restricted route for taxis and buses) in Nov 2011 and I moved house in early Dec 2011. I did inform DVLA of address change and got a new car V5C (11-Jan-2012) and my licence on (30-Dec-2011). I also sold the car involved on 23-Jun-2012. For whatever reason the Newham council had been sending notices to my old address during 2012 and then put the case on hold. Then re-activated it recently as I gather from the Bailiffs (JBW) and then the Bailiffs straight away sent the "Notice of Removal Letter". The bailiffs claim they have sent notices to my address which I have not received (there was contradiction by their own staff that they sent it to my old address and then changed the statement)

Since receiving the notice, I have paid the full amount "under protest". And have written to Bailiffs and the Newham council about my side of the argument.

Now the key question I have is how will this effect my ILR. I have read through other posts on FPN vs PCN as well as the posts on PCNs which were paid immediately. My case here is slightly different because the Bailiffs are called and want to understand

1. whether I should declare this in SET(O) form.
2. has anyone encountered similar issue and did they get ILR without issues?
3. should I add a cover letter during ILR and justify my case, what additional information should I carry ?

I will appreciate if the honorable members can kindly provide your response on this.

Thanks a lot for your prompt reply. Could you please clarify whether it is mandatory to declare and whether if I dont declare then will it show up in the check that the case worker will do for in person appointment? Also, should just declare with the PCN or with all supporting information (License address change date, V5C evidence, council tax etc.) to justify I have not received the notices etc., I am mindful that the case worker may not be the best judge of the PCN issue but just want to make sure I help them make a positive decision. Please advice.

There is only the need to declare spent and unspent convictions. However, you can add further information about the PCN I would be brief and not include associated paperwork.
