Spouse visa and financial requirements

I have been living with my partner for the last year who is Malaysian - he is currently here on a visa already (I think its Tier 5) and works as a pre-reg pharmacist. I am also currently working for the last 2 years for a company. I have around 2,000 savings whilst my partner has around 3,000 savings. We rent a private flat together and share most of the utility bills.

At the moment, my salary is only 17,500 whilst my partner's is 18,500. We plan to marry next month and hopefully apply for the spouse visa. However, am I correct in believing that only my own salary will be considered and not my partners? My partner is looking for work after his pre-reg but the chances are he will be earning around 26-32k as a fully fledged pharmacist. He also speaks practically perfect English and has the certificate to prove that.

Is it worth even applying for a spouse visa? His visa runs out end of August. He can apply to extend that visa if he finds a job but because our circumstances will change, the chances are that he'd be applying for the spouse visa instead.

Edit: forgot to add that we aren't yet married, but plan to marry within the next month

Hi,

I know absolutely nothing about Tier 5, however I do believe you can rely on your joint income which would be 36,000. He will have to have been working for at least 6 months (legally) with that company to be able to count his salary towards the financial requirement (depending under which category you want to apply, ie it could be 12 months).

Just giving my opinion though, I'm sure other more informed members will step forward soon enough to shed light and correct me if im wrong.

Sorry I thought you were in Malaysia.

If you are both here in the UK working legally you can use both incomes to satisfy the financial requirement.
