ILR Approved in Croydon 3rd May -WP + Tier 2 ICT

Hi –
First of all, I want to thank everyone in this forum, who helped me.

I got my ILR on 3rd May through WP + Tier 2 ICT route.

I came to UK on 7th Dec 2007 to till date. I was on WP initially then Tier 2 ICT. All my visa extensions are done in UK, no gap in Visa.

My absences from UK are as follows –

08/12/2008 to 12/01/2009  32 Days  India  Annual Leave
14/05/2009 to 19/05/2009  5 Days Swiss  Annual Leave
26/07/2009 to 05/01/2010  163 Days India  Worked in India (Salary paid only in India)
09/07/2011 to 22/07/2011  13 Days India  Worked in India (Salary paid only in India)
23/10/2011 to 08/11/2011  16 Days India  Worked in India (Salary paid only in India)


The document I submitted –
1. SET (O) Form
2. Passport + BRP Card
3. Life in UK Test certificate
4. Payslips – 6 Months
5. Bank Statements – 6 Months
6. P60 – 2008-09, 2010-11, 2011-12
7. Employer Letter
a. SOC Code + Salary
b. Absence from UK Letter – 165 days absence mentioned as I worked in offshore, due to business implications.

No questions asked, Handed over the approval letter after 3 hours wait.

I am also in same category as yours. I have 152 days absence in 2010 and salary was paid in india. I am due for ILR in June. Could you share the letter template for long absence.

I first entered UK in Jan 2009 on Employer sponsored WP. I stayed in UK for 2 years that is Jan 2009 till Jan 2011. Then went back to India and came back to UK in May 2011 on Tier 2 ICT. Since then I am in UK. In Jan 2014, I will be completing 5 years in UK, but on 2 different Visas (first 2 years on WP and last 3 years on Tier 2 ICT).





To sum up my stay in last 5 years is like this:

Jan 2009-Dec 2009: No break
Jan 2010-Dec 2010: Break of 30 days. Went on holiday to India.
Jan 2011-Dec 2011: Break of 120 days. Went back to India for visa restamping. During this break period I was not having any valid UK visa.
Jan 2012-Dec 2012: Break of 60 days: Went to India on Holiday.
Jan 2013-Dec 2013: No break.

During all these years, I am with the same employer.

My query is:
1. Can I apply for ILR on 2 different Visas?
2. For second term, I entered UK in May 2011 (that is post Apr 2010 when the rule for Tier 2 ICT changed), am I still eligible. Will my start date be considered as Jan 2009 when i came on WP or will it be May 2011?
3. As there was a gap of 4 months (though less than 180 days) between my 2 visaS, during that period I was not in UK, can I still apply for ILR?During these 4 months iwas not having any valid UK visa.

Please share your thoughts.
