BC:BC/Naturalisation eligibility

Hi,

I'm planning to apply for naturalisation around second week of july 2013.

Main applicant:
==========
Initial Entry Clearance Valid From : 23 jul 2007 to 23 jul 2009
Date I First landed in UK : 14 Oct 2007

Later converted to Tier 1(Gen) in 2009 and approved ILR on 6th july 2012

Out of Uk details till date as follows

Initial entry delayed ----------------- 81 days (unpaid)
11 sep 2008 to 21 sep 2008 ------------ 10 days (paid holidays)
26 dec 2009 to 25 jan 2010 ------------ 31 days (paid holidays)
1 may 2010 to 17 may 2010 ------------- 17 days (paid holidays)
29 may 2011 to 27 jun 2011 ------------ 29 days (paid holidays)
26 oct 2012 to 18 nov 2012------------- 22 days (paid holidays)
Total------> 190

Spouse:
=======
First entry into uk 21/09/08

05/08/09 to 29/05/10 ------->296
13/04/11 to 27/06/11-------->74
05/09/12 to 18/11/12-------->73
Total --------->447
She completes 5 years by 22nd sept 2013.

Child:
29/05/10 First entry into uk

13/04/11 to 27/06/11------------->74
05/09/12 18/11/12 --------------->73
Total ------->147

could you please provide your suggestions and clarify the following questions?

1. Could you please tell me when can I submit my application for naturalisation?

2. Is the following application type is correct for each applicant?
Main applicant & Spouse-->AN1
Child------------------------->Mn1

3. If we apply together, Is there any chances of getting approval for spouse as she is out of UK for 447 days

4. What support documents to be enclosed with each application?

5. Planning to apply for myself and my child first then for my wife. is that sounds as right approach?

You could apply on the 6th July 2013 onwards but not during your absences as you need to be physically present 5 years before you apply as well as meeting the other http://www.ukba.homeoffice.gov.uk/briti ... uirements/ standard requirements.

I assume your spouse is settled (has ILR?) She could apply at the same time as you (joint) but her application would be subject to the discretion of the caseworker as at the time she was not the spouse of a BC.

If not she could apply immediately after you are naturalised providing, she is settled, has been resident in the UK for 3 years (and was physically present in the UK 3 years prior to the HO receiving her application). As well as meeting the other http://www.ukba.homeoffice.gov.uk/briti ... ofcitizen/ requirements for a spouse of a BC.

Yes if your children are under 18 that is the correct form. The documents that are required are stipulated on the forms. The absences should not be an issue as they are before the 3 year period. Unless you wait until the 5 year point and apply together then the absences should be ok as there is scope for discretion.
