Partner of a Settled Person (ILR)

Hi,

I am the dependant of a PBS Migrant who has now become settled in the UK. Do I need to switch into the ‘Partner of a Settled Person’ category?

While I was returning from holiday in France, I was questioned at the airport by the border agency staff. He said your spouse is ILR holder and then you should be having BRP card stating dependant of 'settled person' and not dependant of PBS coz that was his initial status.

I said this was what I was advised at Sheffield PEO when I went to extend my stay after my husband got ILR 2 weeks ago. He said will let me go this time but have to change it soon.


I entered UK as PBS dependant (spouse was on Tier 1) on 16th Jan 2012 with visa valid until 5th Dec 2012 as my husband's Tier valid till 3rd Dec.
He got ILR on Nov 11th and then I went to PEO on 23rd Nov where I was asked to extend as PBS dependant.


Please help!

The airport UKBA staff seems to be unaware of the changes in the Immigration Rules.
